General Terms & Conditions

These General Terms & Conditions govern all services provided by Vizzcast LLC (“Vizzcast”, “we”, “our”, or “us”), including but not limited to studio hire, podcast production, video production, Digital Transmission (DTL), equipment rental, internet services, and related production services.

By booking, paying for, accessing, or using Vizzcast’s facilities or services, the Client (“Client”, “you”, or “your”) agrees to these Terms & Conditions, together with any applicable booking platform agreement, quotation, invoice, or written correspondence relating to the booking.

These Terms are intended to protect both Vizzcast and our clients by clearly outlining each party’s rights, responsibilities, operational policies, and booking conditions. Please read them carefully before your booking.

# Terms & Conditions

**Effective Date:** July 10, 2026

These Terms & Conditions (“Terms”) govern all services provided by **Vizzcast LLC** (“Vizzcast”, “we”, “our”, or “us”), including but not limited to studio hire, podcast production, video production, Digital Transmission (DTL), live streaming, equipment rental, internet services, and related production services.

By booking, paying for, or using any Vizzcast service or facility, the Client (“Client”, “you”, or “your”) agrees to these Terms & Conditions.

## Bookings

All bookings are subject to availability and are confirmed upon written confirmation or receipt of payment.

Booking times include setup, rehearsals, filming, recording, equipment pack down, cleaning, and final departure. Clients are responsible for ensuring sufficient time has been booked for all production activities.

Detailed access information, operational procedures, and studio guidelines will be provided prior to your booking.

## Payments

Payment terms will be outlined in your quotation, invoice, or booking confirmation.

Credit card payments may incur a processing fee. Where available, ACH bank transfer and Zelle payments do not incur processing fees.

Additional charges may apply for equipment hire, overtime, studio reset, cleaning, internet upgrades, crew, or other services requested during the booking.

## Cancellation Policy

**Full Refund**

Bookings cancelled within 24 hours of confirmation are eligible for a full refund, provided the booking start time is more than 48 hours away.

**50% Refund**

Bookings cancelled more than 48 hours before the scheduled start time are eligible for a 50% refund.

**Non-Refundable**

Bookings cancelled less than 48 hours before the scheduled booking time are non-refundable.

Credit card processing fees and third-party booking platform fees are non-refundable.

## Studio Use

Clients agree to use the studio responsibly and in accordance with all operational policies provided before their booking.

Depending on the booking type, clients may have exclusive access to a single studio or the entire facility. Access to additional studios or production areas requires prior approval or the appropriate booking.

Furniture and movable set elements may be repositioned during the booking but must be returned to their original locations before departure unless otherwise agreed.

## Equipment

Only equipment included within the booking or separately hired through Vizzcast may be used.

Equipment may not be removed from the premises without prior written approval.

Any unauthorised equipment use will be charged at Vizzcast’s standard rental rates.

The Client is responsible for any loss or damage to equipment during the booking.

## Additional Charges

Additional charges may apply, including but not limited to:

– Overtime
– Equipment hire
– Cleaning
– Studio reset
– Damage or repairs
– Call-out fees
– Additional crew or production services
– High-speed internet upgrades

Applicable charges will be outlined during the booking process or within the Studio Information & Booking Guide.

## Damage & Liability

The Client is responsible for any damage caused to the studio, equipment, furniture, building, or property by the Client or anyone attending under their booking.

Any damage must be reported immediately.

Vizzcast is not liable for indirect, incidental, consequential, or special damages, including loss of profits, business interruption, or loss of data.

Vizzcast’s total liability arising from any booking shall not exceed the total amount paid by the Client for the applicable booking.

## Personal Property

Clients are responsible for all personal belongings, production equipment, media, and other property brought onto the premises.

Vizzcast accepts no responsibility for the loss, theft, or damage of personal property before, during, or after a booking.

Items left behind may be retained for a limited period before being disposed of or donated.

## Prohibited Activities

Unless approved in writing by Vizzcast, the following are prohibited:

– Smoking or vaping inside the premises
– Illegal drugs or unlawful activity
– Open flames or pyrotechnics
– Glitter, confetti, paint, powders, body oils, fake snow, feathers, hay, or similar materials
– Tampering with studio infrastructure or permanently installed equipment
– Any activity that may create an unsafe environment or cause damage

Vizzcast reserves the right to terminate a booking without refund where these conditions are breached.

## Insurance

Certain productions may require the Client to provide proof of insurance or a Certificate of Insurance (COI).

Where required, minimum coverage limits and additional insured requirements will be provided before the booking.

## Content & Recording Responsibility

The Client is solely responsible for obtaining all licences, permissions, releases, music rights, location approvals, and talent consents required for their production.

Vizzcast accepts no responsibility for content created, recorded, streamed, or distributed by the Client.

## Force Majeure

Vizzcast shall not be liable for delays, interruptions, cancellations, or failure to perform caused by circumstances beyond its reasonable control, including power outages, internet interruptions, severe weather, building maintenance, elevator failures, government action, emergencies, strikes, or other force majeure events.

## Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

## Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

## Entire Agreement

These Terms & Conditions, together with any quotation, booking confirmation, invoice, equipment rental agreement, and any operational policies provided by Vizzcast, constitute the entire agreement between the Client and Vizzcast relating to the booking.
